Currently, the following jurisdictions recognize common law marriage:

Colorado
District of Columbia
Idaho
Iowa
Kansas
Montana
Ohio
Oklahoma
Pennsylvania
Rhode Island
South Carolina
Texas

Some states recognize a common law marriage originated and approved in another state, but will not recognize common law marriage originating in their state. Check the law for each state for specific rules regarding common law marriage or consult with an attorney.
